Breaking News: CMS Delays “Two-Midnight” Rule

Succumbing to pressure from hospitals and physicians, CMS is delaying the “two-midnight” rule for Medicare hospital admissions until after September 30. CMS will now wait until after September 30 to start auditing claims under the rule. However, the agency will still allow Medicare’s administrative contractors to review short stays and deny payment if the patient record doesn’t support medical necessity but these reviews are intended to be strictly instructional.
